Terms of Service

You must be at least 13 years old to use the Service and at least 18 (or the age of majority in your jurisdiction) to make a purchase or enter into a consulting engagement.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us at info@earquality.com if you suspect unauthorized access.

Prices for products and services are shown on the Service in US dollars unless stated otherwise and are exclusive of applicable taxes, which are calculated at checkout. By placing an order you authorize us (through our payment processor, Stripe) to charge your payment method.

Physical merchandise is fulfilled and shipped by Printful. See our Shipping Policy for details. Digital products are delivered via download link after payment is confirmed. See our Refund Policy for cancellation and refund terms.

You agree not to:

• reverse engineer, scrape, or attempt to gain unauthorized access to the Service;
• upload content that is unlawful, infringing, harassing, or harmful;
• use the Service to impersonate any person or entity;
• resell or redistribute digital downloads without written permission.

The Service and all content on it — including the Ear Quality name, logo, written copy, design, code, and any audio or visual works — are owned by Ear Quality LLC or its licensors and are protected by intellectual property laws. Purchasing a digital product grants you a personal, non-exclusive, non-transferable license to use the file; all other rights are reserved.

Engagements for tailored artist support, development, or creative strategy are governed by a separate written agreement signed by both parties. These Terms do not by themselves create a consulting relationship.

The Service is provided "as is" and "as available". To the maximum extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, Ear Quality LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues. Our aggregate liability for any claim arising out of or relating to the Service will not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) US $100.

We may suspend or terminate your access to the Service at any time for any reason, including violation of these Terms. You may stop using the Service at any time.

These Terms are governed by the laws of the State of New York, without regard to its conflict of laws principles. The exclusive venue for any dispute is the state and federal courts located in Erie County, New York.

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
